Define: Restraining Order

A restraining order, also known as a protective order or an injunction, is a legal order issued by a court to protect an individual from harassment, abuse, threats, or other forms of harm inflicted by another person. Restraining orders typically prohibit the individual subject to the order, known as the respondent, from contacting, approaching, or coming near the protected person, known as the petitioner. They may also include provisions such as requiring the respondent to stay away from the petitioner’s home, workplace, or other specified locations. Restraining orders are commonly sought in cases involving domestic violence, stalking, harassment, or other forms of abuse. Violating a restraining order can result in legal consequences, including arrest and criminal charges. Restraining orders are an important legal tool used to provide protection and support to individuals who are at risk of harm from others.

An order from a court directing one person not to do something, such as making contact with another person, enter the family home or remove a child from the state. Restraining orders are typically issued in cases in which spousal abuse or stalking is feared — or has occurred — in an attempt to ensure the victim’s safety. Restraining orders are also commonly issued to cool down ugly disputes between neighbours.
