Full Definition of Grey Area


A grey area of the law is one in which the law is not entirely clear because there is conflicting case law or because the law in the area has not been decided in a long time making its applicability dubious. This may occur where there is a persuasive authority to the contrary perhaps from obita dicta or because the case originated in another jurisdiction.
