Define: Direct Examination

Direct examination is a stage of trial proceedings in which an attorney questions their own witness in order to elicit testimony and evidence that supports their case. The purpose of direct examination is to present the witness’s version of events, facts, or expert opinions to the court or jury in a clear and coherent manner. During direct examination, the attorney typically asks open-ended questions designed to allow the witness to provide narrative responses and explain relevant information. Direct examination aims to establish the credibility of the witness, corroborate key facts, and advance the attorney’s legal arguments or theories. It is an essential component of the adversarial process in litigation, providing an opportunity for each party to present their case and evidence to the trier of fact.

At trial, the initial questioning of a party or witness by the side that called him or her to testify. The major purpose of direct examination is to explain your version of events to the judge or jury and to undercut your adversary’s version. Good direct examination seeks to prove all facts necessary to satisfy the plaintiff’s legal claims or causes of action — for example, that the defendant breached a valid contract and, as a result, the plaintiff suffered a loss.
