A community sentence, also known as a community order or non-custodial sentence, is a type of punishment imposed by a court as an alternative to imprisonment for certain criminal offenses. Instead of serving time in jail, individuals sentenced to community sentences are required to complete specific requirements or conditions within the community under the supervision of probation services. These conditions may include performing unpaid work, attending rehabilitation programs, participating in education or training, adhering to curfews, or complying with other restrictions aimed at addressing the underlying causes of their offending behaviour and reducing the risk of reoffending. Community sentences are designed to promote rehabilitation, provide opportunities for offenders to make amends to their communities, and alleviate prison overcrowding by reserving custody for more serious or dangerous offenders.

Under current Sentencing legislation, a criminal conviction may attract a fine (see: Fine sentencing), a Custodial sentence, or a community sentence. Community sentences are generally felt to be suitable for offences less serious than those for which imprisonment is appropriate. Currently, the following community sentences are recognized.

  • Probation

  • Combination order (i.e., a combination of the above)

  • Drug testing and treatment order
  • Attendance order
