An Apgar Score is the score given to a newborn child by their doctor that measures their pulse, grimace, reflex, irritability, skin colour, respiration and muscle tone. Healthier babies have higher Apgar Scores. There is a broad range of injuries which can occur to a baby during the birthing process including brain damage (leading to cerebral palsy), brachial plexus injuries, nerve damage, and orthopaedic injuries. Apgar Scores are one piece of evidence which can be used in personal injury cases.

If there is a birth injury the healthcare provider generally will argue the injury was not their fault, was not preventable, was not caused by the birthing process, and happened long before the mother arrived at the hospital. Talk to a personal injury lawyer if your baby was injured during birth.
